Agreement to Terms

By accessing fortyup.in or engaging FortyUp for any service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

Who We Are

FortyUp is a full-stack IT agency based in Bengaluru, Karnataka, India. We serve startups, entrepreneurs, restaurants, institutes, and businesses across India and internationally. Our contact email is fortyup.partnerships@gmail.com and our phone is +91 9555974189.

Services

FortyUp provides the following categories of services:

• ·Software development: web applications, mobile apps, UI/UX design, cloud infrastructure and DevOps, API development and integrations, e-commerce solutions, QA and automated testing, cybersecurity basics, data engineering, and maintenance and managed support
• ·SEO and LLM visibility: ranking on Google and citation by AI assistants like ChatGPT, Gemini, and Perplexity
• ·AI agents: internal employee assistants, sales agents, customer support agents, research agents, procurement agents, HR assistants, and multi-agent workflows
• ·Custom AI systems: fine-tuned models, RAG pipelines on company documents, and fully bespoke LLM systems built around your business
• ·Business automation: CRM automation, finance automation, invoice processing, email automation, supply chain workflows, and lead qualification systems

All projects begin with a G-Meet call (the IT date) to align on requirements before any work commences. A requirements document is shared and approved before development starts.

Project Delivery and Ownership

Upon full payment, clients receive:

• ·100% of the source code, you own it completely
• ·Full intellectual property rights to the project deliverables
• ·Deployment to a live URL (where applicable)
• ·A handover walkthrough session
• ·One week of post-delivery support for bug fixes directly related to the delivered scope

After the one-week support window, continued maintenance is available under a separate managed support agreement. FortyUp retains no rights to any code or IP developed for a client after full payment is received.

Revisions and Scope

Revisions within the agreed requirements document are included. Requests that fall outside the agreed scope will be quoted separately. FortyUp will always flag scope changes before billing for them.

Client Responsibilities

You agree to:

• ·Provide accurate and complete project requirements
• ·Respond to queries and feedback requests within a reasonable time
• ·Make payments on schedule
• ·Attend the handover session and raise issues within the one-week support window
• ·Not use deliverables for unlawful purposes

Confidentiality

Both parties agree to keep each other's confidential business information private. FortyUp will not disclose your project details, source code, or business data to third parties without your consent, except as required by law.

Limitation of Liability

FortyUp's total liability for any claim arising from our services is limited to the total amount paid by you for the specific project in question. FortyUp is not liable for indirect, incidental, special, or consequential damages including loss of profits, data, or business opportunity.

Disclaimer of Warranties

Services are delivered in good faith and to the best of our ability. FortyUp does not guarantee specific business outcomes such as revenue, traffic, or ranking positions. SEO and LLM visibility results depend on third-party platforms and may vary.

Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Changes to These Terms

FortyUp may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.
